The ICC’s milestone decision

How court’s arrest warrant for Benjamin Netanyahu will hurt – and possibly help – him.

Editor’s note: This interview was originally published on 20 May 2024, and was republished on 21 November 2024 in light of the news that the International Criminal Court had issued arrest warrants for Israel’s prime minister Benjamin Netanyahu, the former defence minister Yoav Gallant and the Hamas’s military commander Mohammed Deif. The ICC’s judges said there were “reasonable grounds” that Netanyahu, Gallant and Deif had “criminal responsibility” for alleged war crimes and crimes against humanity. Both Israel and Hamas have denied the allegations. The ICC originally announced it was seeking arrest warrants for the Israeli leaders and senior Hamas figures in May. Two of the three Hamas leaders named then – Yahya Sinwar and Ismail Haniyeh – have since been assassinated.

On Monday 20 May, the chief prosecutor of the International Criminal Court (ICC), Karim Khan, announced that he was seeking arrest warrants for Benjamin Netanyahu and Hamas’s leader Yahya Sinwar for war crimes and crimes against humanity, as well as other Israeli and Hamas leaders.
