In the past 10 years or so, the digital environment has changed so quickly that it has been difficult for legislation to keep pace.

With the consumer content that Web 2.0 has generated, there is ever more data floating about the ether. Consumers supply companies with personal details so that they can gain access to online tools or content; the companies use those details to market to those consumers. When one company buys another company, who does the data belong to? Certainly it is not in the hands of the consumer.

Widely publicised breaches of security regarding data have highlighted consumer concerns about how their personal details are treated, as well as online fraud and identity theft.
